On Tuesday, November 11, 2003, the National Regulatory Authority for Communications held at its headquarters an interactive reunion addressed to the operators newly entered on the market, entitled “Unbundled access to local loop”. The debates follow the public consultation process launched by ANRC on October 2, 2003 on the ANRC Draft Decision regarding the principles and prerequisites of the reference offer for unbundled access to local loop. 50 representatives from 42 companies that intend to provide telephone, Internet access, leased lines and data transmissions services took part in the meeting.
The reunion was an opportunity for the ANRC specialists to gather comments from the operators regarding this draft decision, to present and explain in detail the means of access to local loop, the procedure for equipment installing and connecting, and any other measures that are to be undertaken by the operators in order to value the right of access to local loop. The ANRC representatives answered the questions formulated by the communications industry, trying to explain any aspects of the regulatory activity the operators thought unclear.
According to the draft decision under discussion, Romtelecom has the obligation to provide unbundled access to the local loop, under non-discriminatory conditions, to all the networks operators or electronic communications services providers that require it. Also, the operator shall publish a reference offer that includes both the services of providing access to local loop, and the tariffs and conditions under which he offers these services, with the observance of the decision’s provisions, regarding access to local loop, which ANRC will adopt. During the first part of the meeting, the operators raised issues such as: the mechanism for dividing the costs in case the fixed public network of the operator designated as having significant market power is extended, upon the requests and to the benefit of the operators with whom agreements for access to the local loop were concluded, as well as the issue of the collocation by Romtelecom of the access equipments.
During the second part of the meeting, the operators discussed other subjects of common interest, such as the opportunity of shorter deadlines for the negotiation and implementation of the agreements for local loop interconnection or finding solutions for accelerating the process of negotiating the agreements concluded based on the reference interconnection offer. As regards the latter issue, the operators proposed as solutions the following: the establishment of a reasonable deadline for determining the necessary technical solutions for interconnection or of a standard interconnection contract that should constitute the base for negotiation.
The Authority, acknowledging the fact that the regulation of the operators’ access to the fixed public telephone network and especially the regulation of the access to the local loop are issues with high impact on the electronic communications market, pledges for the active involvement of the industry in the regulatory process, through the public consultation procedure. ANRC will take into consideration these proposals, will analyze them and will decide on the opportunities of integrating them into the regulatory activity.
This meeting will be followed by a similar reunion where will be invited the representatives of S.C. Romtelecom S.A – the operator designated as having with significant power on the market of unbundled access to local loop, total or shared, to local loop constituted of a pair of twisted metallic wires, for the purpose of the provision of broadband electronic communications services and publicly available telephone services at fixed locations, as well as representatives of the mobile telephone services. The opinions presented during these meeting will be analysed by ANRC and discussed during a reunion of the ANRC Consultative Council.
Accesul neconditionat la bucla locala 11.11.2003 Marti, 11 noiembrie 2003, Autoritatea Nationala de Reglementare în Comunicatii a gazduit la sediul sau central o reuniune interactiva adresata operatorilor nou intrati pe piata, cu tema “Accesul neconditionat la bucla locala”. Dezbaterile acestei reuniuni vin în continuarea procesului de consultare lansat de ANRC în data de 2 octombrie 2003 asupra proiectului de Decizie a presedintelui ANRC privind principiile si preconditiile ofertei de referinta pentru accesul neconditionat la bucla locala. La întâlnire au participat 50 de reprezentanti a 42 de companii care intentioneaza sa furnizeze servicii de telefonie, acces la internet, linii închiriate sau transmisiuni de date. Reuniunea de astazi a fost un prilej pentru specialistii ANRC de a primi observatiile si comentariile operatorilor pe marginea acestui proiect de decizie aflat spre consultare pe pagina de Internet a ANRC, de a prezenta si explica în detaliu modalitatea de acces la bucla locala, procedura de instalare si conectare a echipamentelor, precum si orice alte demersuri care trebuie efectuate de noii operatori pentru a putea valorifica deplin dreptul de acces la bucla locala. Reprezentantii ANRC au raspuns întrebarilor venite din partea industriei de comunicatii încercând sa clarifice orice aspecte ale activitatii de reglementare cu care acestia s-au confruntat în ultima perioada. Conform proiectului de decizie discutat, Romtelecom are obligatia de a furniza accesul neconditionat la bucla locala, în conditii de nediscriminare, tuturor operatorilor de retele sau furnizorilor de servicii de comunicatii electronice care solicita acest lucru. De asemenea, operatorul va trebui sa publice o oferta de referinta care sa includa atât serviciile de furnizare a accesului la bucla locala, cât si tarifele si conditiile în care va oferi aceste servicii, cu respectarea prevederilor deciziei care va fi adoptata de ANRC în privinta accesului la bucla locala. În cadrul primei parti a dezbaterii s-au ridicat probleme precum mecanismul de împartire a costurilor în cazul extinderii unor segmente ale retelei publice fixe de acces a operatorului national, desemnat ca operator cu putere semnificativa, la cererea si în beneficiul operatorilor cu care au fost încheiate acorduri de acces la bucla locala sau problema gazduirii (colocarii) de catre RomTelecom a echipamentelor pentru acces. În cadrul celei de-a doua parti a întâlnirii de astazi, operatorii prezenti au dezbatut alte subiecte de interes comun precum oportunitatea reducerii termenelor de implementare si negociere a acordurilor de interconectare la bucla locala sau solutii pentru accelerarea procesului de negociere a acordurilor care se încheie în baza ofertei de referinta pentru interconectare. Cu privire la aceasta ultima problema, operatorii au propus ca variante de urgentare a procesului de negociere a interconectarii: stabilirea unui termen rezonabil pentru determinarea solutiei tehnice necesare pentru interconectare sau punerea la dispozitia operatorilor, într-un termen cât mai scurt, a unui contract cadru de interconectare care sa constituie o baza de negociere. Autoritatea, constienta de faptul ca reglementarea accesului operatorilor la reteaua publica fixa de telefonie si mai ales reglementarea accesului la bucla locala sunt probleme cu impact major asupra pietei de comunicatii electronice, sustine implicarea activa a industriei în procesul de reglementare, prin intermediul procesului de consultare publica. ANRC va lua în considerare toate aceste propuneri, le va analiza si va decide asupra oportunitatii integrarii lor în cuprinsul activitatii de reglementare. În final, cei prezenti au fost de acord cu oportunitatea reiterarii acestui gen de reuniuni de consultare. Întâlnirea de astazi va fi urmata de o reuniune similara la care vor fi invitati reprezentanti ai S.C. Romtelecom S.A – operatorul desemnat ca având putere semnificativa pe piata furnizarii accesului neconditionat, total sau partajat, la bucla locala constituita dintr-o pereche de fire metalice torsadate, în scopul furnizarii de servicii de comunicatii electronice în banda larga si de servicii de telefonie destinate publicului la puncte fixe, precum si reprezentanti ai operatorilor de telefonie mobila. Punctele de vedere identificate în cadrul acestor întâlniri vor fi analizate de ANRC si dezbatute în cadrul unei reuniuni a Consiliului Consultativ al ANRC.
